These Terms of Service (“Terms”) govern your access to and use of www.growwithgta.com and other websites, forms, content, and online resources operated by GTA Solutions LLC under the brand Grow with GTA (“Grow with GTA,” “we,” “us,” or “our”).

By accessing or using our website, you agree to these Terms.

If you do not agree, do not use the website.

1. ABOUT GROW WITH GTA

Grow with GTA provides marketing and related business services, which may include:

Local search engine optimization;

Google Business Profile optimization;

Reputation and review management;

Email marketing;

Social media management;

Website and landing-page services;

Paid advertising;

Marketing automation; and

Other marketing, consulting, and technology-enabled services.

Services offered may change from time to time.

2. BUSINESS USE

Grow with GTA primarily provides services to businesses.

The information and services presented through our website are intended primarily for persons acting on behalf of a business or commercial enterprise.

3. WEBSITE INFORMATION IS NOT A GUARANTEE

Information on our website is provided for general informational and marketing purposes.

Examples, testimonials, case studies, projections, estimates, marketing statistics, or descriptions of potential outcomes do not constitute guarantees that you or your business will achieve the same or similar results.

Marketing results vary substantially based on numerous factors outside Grow with GTA's control.

4. NO GUARANTEE OF MARKETING RESULTS

Grow with GTA does not guarantee:

Google Maps or local search placement;

Website traffic;

Leads;

Calls;

Appointments;

Customer reviews;

Review ratings;

Sales;

Revenue;

Return on investment;

Advertising performance;

Social media growth; or

Any particular business result.

Search engines, social networks, advertising networks, review platforms, and other third-party platforms independently control their algorithms, policies, rankings, moderation decisions, account restrictions, and functionality.

Grow with GTA is not responsible for changes or decisions made by those third parties.

5. CLIENT SERVICES

Submitting an inquiry, scheduling a consultation, requesting a proposal, or using this website does not by itself create a client relationship.

Paid marketing services may be subject to a proposal, order form, Client Services Agreement, statement of work, checkout terms, or other agreement.

If there is a conflict between these website Terms and a separately executed Client Services Agreement concerning paid services, the Client Services Agreement controls with respect to those services.

6. SUBSCRIPTIONS AND PAYMENTS

Certain services may be offered on a recurring monthly basis and may require an initial setup fee.

The specific fees, billing frequency, service scope, and other commercial terms will be disclosed when the service is purchased or in the applicable service agreement.

Recurring services may automatically renew and continue to be billed until canceled in accordance with the applicable agreement.

Unless otherwise expressly stated in writing, payments and setup fees are nonrefundable.

7. MARKETING COMMUNICATIONS

If you provide your contact information, we may contact you concerning your inquiry, requested services, appointments, account, or existing business relationship.

Where you separately consent to marketing communications, we may also send promotional communications by email, telephone, or text message in accordance with applicable law.

Consent to receive automated marketing calls or text messages is not a condition of purchasing services where prohibited by law.

You may withdraw consent or opt out using the methods provided in the applicable communication.

8. ACCEPTABLE USE

You agree not to use our website to:

Violate any law or regulation;

Infringe another person's intellectual property or privacy rights;

Transmit malicious software;

Attempt unauthorized access to our systems;

10. THIRD-PARTY SERVICES

Our website and services may interact with or link to third-party websites, platforms, applications, software, and services.

Grow with GTA does not control those third parties and is not responsible for their availability, policies, security, content, actions, or performance.

11. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

GROW WITH GTA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.

We do not warrant that the website will operate uninterrupted, error-free, or free of harmful components.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROW WITH GTA, GTA SOLUTIONS LLC, AND THEIR OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE.

To the extent liability cannot legally be excluded, our aggregate liability arising from use of the public website will not exceed $100 or the amount you paid specifically for access to the website, whichever is greater, except where such limitation is prohibited by law.

Liability relating to paid client services is governed by the applicable Client Services Agreement.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Grow with GTA, GTA Solutions LLC, and their owners, employees, contractors, agents, and affiliates from claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The Effective Date at the top of this page indicates when these Terms were last revised.

Your continued use of the website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

17. DISPUTE RESOLUTION

Before initiating formal proceedings, you and Grow with GTA agree to make a good-faith effort to resolve a dispute informally.

If a dispute cannot be resolved informally within 30 days after written notice, the dispute shall, to the extent permitted by law, be resolved through binding individual arbitration administered by a mutually agreed arbitration provider or, if the parties cannot agree, a recognized arbitration provider selected in accordance with applicable law.

Arbitration shall take place in Georgia unless the parties agree otherwise and may be conducted remotely where permitted.

Disputes must be brought on an individual basis and not as a plaintiff or class member in a purported class, consolidated, or representative proceeding, to the extent permitted by law.

Either party may seek temporary or injunctive relief from a court of competent jurisdiction when necessary to protect intellectual property, confidential information, or prevent unauthorized access or misuse.

If any portion of this arbitration provision is determined unenforceable, the remaining portions shall remain effective to the maximum extent permitted by law.

18. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in effect.

19. NO WAIVER

Failure by Grow with GTA to enforce a provision of these Terms does not waive our right to enforce it later.
